The family constitution is a statement of a family’s relationship with its business. This will provide a guide to current and future family members on the governance of the business and related family matters. It is not legally binding but without concensus it cannot work. Often without a constitution a family ceases to work without which the business may fail.

Each family’s constitution is different, a unique document for a unique combination of personalities and business but all will include elements of:

• Values and goals
• Conditions for shareholding and employment
• Responsibility and accountability
• The relationship of ‘in laws’ to the business
• Responsibilities of non working shareholders
• Succession
